I Terms and Conditions of Shuttler LLC

1 Scope of application

The General Terms and Conditions apply to the use of the personal, electronic or telephone mediation services offered by Shuttler, with which transport services are mediated between the passenger and the carrier.
The customer concludes a contract of carriage with the carrier for the purpose of carriage. The carriage of passengers is subject to separate terms and conditions (Terms and Conditions of Carriage), which depend on the respective contractual carrier. The carrier’s terms and conditions of carriage are accessible on the Shuttler website.

2 Contractual partners

The contractual partner for the arrangement of journeys is Shuttler GmbH with its registered office in Zurich (Hardturmstrasse 161).
In matters concerning the carrier (including rebookings, cancellations, additional services), Shuttler may represent the carrier in accordance with the carrier’s conditions of carriage.

3 Payment

The services that can be booked via the Shuttler must be paid for with major credit cards.
Shuttler may provide for other means of payment.
Shuttler may charge a fee for payment methods that represent additional administrative expenses.
Shuttler may offer general or personalised vouchers for payment of services on the Shuttler.
Shuttler may offer special discount codes or other benefits.
Trading of vouchers or discount codes is prohibited.

4 Exclusion

Shuttler can exclude individual customers from using the brokerage services via Shuttler for up to six months if they violate the following rules:
a. Criminal behaviour (including assault and harassment) towards employees or property of the carrier, employees of Shuttler or other passengers.
b. Riding without a valid ticket
c. Trafficking in vouchers or tickets
d. Misuse of the Shuttler data processing system.
In the event of minor cases, Shuttler will issue a one-off warning valid for six months.

5 Cancellation and Rebooking

The carrier’s services booked via Shuttler can be cancelled again via Shuttler.
The carrier’s conditions of carriage are applicable.

Shuttler guarantees the following minimum conditions irrespective of the Conditions of Carriage of the carrier.

  • Cancellations by the customers are possible up to 6 hours before departure. Refunds will be made against a voucher. A fee of 10.- may be charged.
  • In case of cancellation by the carrier the passenger has the right to get a full compensation of the ticket price. If the cancellation by the carrier takes place later then 14 days prior to departure, the passenger has the right to an additional compensation of 50% of the ticket price. 
  • It is not considered cancellation when an alternative mean of transportation is offered. By booking via Shuttler, the customer agrees that Shuttler may rebook him/her with another carrier at any time without his/her consent, provided that the essential contractual service (carriage) is maintained. In this case, the conditions of carriage of the new carrier are applicable. In such case, the customer has the right to withdraw from the contract of carriage. Any right to claim damages is excluded.

6 Luggage

Shuttler guarantees the following minimum conditions irrespective of the Conditions of Carriage of the carrier.

  • One piece of hand luggage with a maximum size of 42*30*18 cm and a maximum weight of 7 kg.
  • One piece of hold luggage with a maximum size of 50*30*80 cm and a maximum weight of 20 kg.

All other additional services including extra luggage, transport of skis or bicycles are subject to the conditions of carriage of the relevant carrier. It is recommended to contact the relevant carrier beforehand. 

7 Passengers

Shuttler guarantees the following minimum conditions irrespective of the Conditions of Carriage of the carrier regarding passenger transport:

  • Passengers with a ticket have the right to get transported according to their ticket or within 2 hours after departure. If the carrier has to cancel the transport, passengers have the right for a full refund of the ticket price.
  • Passengers below three years without their own child seat and other categories of passengers that for technical reasons can not be transported, can be excluded from transportation. Is it inevitable that the carrier cancels a ticket in such case, the passengers have the right for a full refund of the ticket price and assistance in finding other travel options. 

8 Liability

In principle, Shuttler is only liable in the event of intent or gross negligence for errors in the mediation and booking process.
Any further liability on the part of Shuttler for property damage or personal injury is excluded.

9 Severability clause

Swiss law shall apply. The place of jurisdiction for disputes arising from the contractual relationship between the customer and Shuttler is Zurich (CH). Should individual provisions of the Swiss legal system at the time of the conclusion of the contract contradict these GTC, this shall not affect the validity of the rest of the GTC.
